The case ultimately concluded before the Court of Appeal with the reversal of the first-instance judgment and dismissal of the claimant's action.
The dispute began with the claimant alleging that he had advanced the client a loan of SAR 1,125,925 through a cheque and seeking repayment of the full amount.
During the proceedings, however, the amount claimed changed. The claimant later referred to SAR 700,000, before ultimately pursuing SAR 650,000.
These changes in the amount and basis of the claim became important elements of the defence strategy, together with the cheques, documentary evidence and final settlement relating to the transaction between the parties.
