The dispute involved two partners in a Hajj and Umrah services company with assets and investments valued at approximately SAR 10 million. One partner sought disclosure of the company’s budgets, financial statements, and corporate documents, alleging that access had been denied.The defence established that the claimant was himself a partner with administrative authority and existing access to the company’s records. When the court required evidence of denied access, the claimant failed to provide sufficient proof and requested the client’s oath. The client took the oath denying the allegation, and the claim was dismissed in the client’s favour.

The dispute centred on a partner’s request for financial disclosure and access to company documents, and whether there had been any actual refusal by the client to permit such access.
The principal issues reviewed included:
Reviewing the rights and obligations of each partner and the management powers associated with their position in the company.
Assessing the disclosure request and whether the company’s budgets were available to partners within the existing corporate framework.
Reviewing the claimant’s right of access to the financial statements and whether there had been any actual obstruction or refusal.
Assessing the request for delivery of company records in light of the claimant’s status and administrative access.
Evaluating whether sufficient evidence existed to establish the allegation that the client had refused to provide access to the requested materials.
Preparing and presenting the legal arguments demonstrating the claimant’s actual position within the company and the lack of sufficient evidence supporting the claim.
A central issue was the distinction between a partner’s right to inspect company information and the separate allegation that the client had prevented the exercise of that right.
The claimant was not an external party but a partner with management authority within the company. Demonstrating his ability to attend the company and access records became a key component of the defence.
The matter required analysis of the company’s budgets and financial statements and the extent to which they were available within the partnership relationship.
Each allegation had to be separated and tested against the evidentiary requirements necessary to establish a claim of withholding documents.
Once the court required the claimant to produce evidence, the matter required careful handling of the evidentiary stage through to the request for the client’s oath.
The defence strategy also aimed to prevent the same unsupported allegations from becoming the basis of repeated or derivative disputes between the partners.

In partnership disputes, the claimant’s own position within the company can be highly relevant to determining whether the alleged obstruction occurred.
Evidence therefore becomes particularly important where the claim is based on an assertion of refusal that is not supported by documentary proof.
